Terms of service

These Terms of Service ("Terms") govern your use of befoure.au (the "Site") and any purchases you make from us. The Site is operated by Befoure ("we", "us", "our"). By using the Site or placing an order, you agree to these Terms.
If you do not agree to these Terms, please do not use the Site.
1. Eligibility
To purchase from the Site you must be at least 18 years old, or have the consent of a parent or guardian. By placing an order, you confirm that the information you provide is accurate and that you are legally able to enter into a contract with us.
2. Products and pricing
We do our best to display our products and their colours, packaging, and ingredients accurately. Minor variations may occur and are not a defect.
Prices are shown in Australian Dollars (AUD) and include GST where applicable. Shipping is calculated at checkout. We may change prices and product availability at any time without notice, though changes will not affect orders we have already accepted.
We reserve the right to limit quantities, refuse or cancel orders (for example, where stock is unavailable, pricing was clearly incorrect, or we suspect fraud), and discontinue products at any time.
3. Orders
When you place an order, you make an offer to buy the products in your cart at the listed price. The contract is formed only when we send you an order confirmation email. Receipt of an order acknowledgement (sent automatically by our checkout) is not acceptance of your order.
If we cannot accept your order, we will refund any amount you have paid in full.
4. Payment
Payment is taken at checkout via the payment methods shown on the Site. By submitting payment details, you confirm that you are authorised to use the chosen payment method. Payment processing is handled by Shopify and the relevant payment provider; we do not store full card details.
5. Shipping and delivery
Shipping options, costs, and estimated delivery times are shown at checkout and in our Shipping Policy. Delivery timeframes are estimates only and we are not liable for delivery delays caused by carriers, weather, customs, or other events outside our reasonable control.
Risk of loss passes to you when the carrier delivers the goods to the address you provided.
6. Returns and refunds
Our returns, exchanges, and refund process is set out in our Refund Policy / Returns Policy. Your statutory rights under the Australian Consumer Law are not affected by that policy.
7. Our products and the Australian Consumer Law
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure, and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy under the Australian Consumer Law that cannot lawfully be excluded, restricted, or modified.
8. Use of the product
Befoure products are cosmetic products. They are intended for external use only, in accordance with the directions on the packaging and on the product page. Do not use if you have known sensitivities to any listed ingredient. Patch-test before first use. Stop using the product and seek medical advice if irritation occurs.
Information on the Site (including product descriptions, ingredient explanations, and any "before and after" imagery) is general in nature and is not medical or professional advice. Results vary between individuals.
9. Accounts
If you create an account, you are responsible for keeping your login credentials secure and for any activity under your account. Tell us as soon as possible if you suspect unauthorised access. We may suspend or close accounts that breach these Terms or are used for fraudulent activity.
10. Acceptable use
You agree not to use the Site to:
- breach any law, regulation, or third-party right;
- transmit malware, viruses, or other harmful code;
- attempt to gain unauthorised access to the Site, our systems, or other users' accounts;
- scrape, harvest, or otherwise extract data in bulk except as expressly permitted; or
- impersonate any person or entity, or misrepresent your affiliation with any person or entity.
11. Intellectual property
All content on the Site — including the Befoure name, logos, product photography, packaging design, written copy, and underlying code — is owned by us or our licensors and is protected by copyright, trade mark, and other laws. You may view and use the Site for personal, non-commercial purposes. You must not copy, reproduce, modify, distribute, or commercially exploit any part of the Site without our prior written permission.
12. User-generated content
If you submit reviews, photos, comments, or other content to us or our social channels ("User Content"), you grant us a non-exclusive, royalty-free, worldwide, perpetual licence to use, reproduce, modify, and display that User Content for marketing and operational purposes, with attribution where reasonably practicable. You confirm that your User Content does not infringe anyone else's rights.
We may remove User Content at our discretion, including content that is offensive, misleading, or otherwise inappropriate.
13. Third-party links and services
The Site may contain links to third-party websites, apps, or services. We are not responsible for the content, products, or practices of those third parties. Your use of any third-party site is at your own risk and subject to that third party's terms.
14. Disclaimers and limitation of liability
Subject to clause 7 (Australian Consumer Law) and to the maximum extent permitted by law:
- the Site and all content are provided on an "as is" and "as available" basis;
- we do not warrant that the Site will be uninterrupted, error-free, secure, or free of viruses; and
- our total liability to you arising out of or in connection with these Terms or your use of the Site is limited, at our option, to resupplying the relevant goods or refunding the price you paid for them.
We are not liable for indirect, incidental, consequential, special, or punitive losses, or for loss of profits, revenue, data, or goodwill, arising out of or in connection with these Terms or the Site, except where such liability cannot lawfully be excluded.
15. Indemnity
You agree to indemnify us against any loss, damage, cost, or expense we suffer arising from your breach of these Terms, your misuse of the Site, or your infringement of any law or third-party right, except to the extent caused by our own negligence or wilful misconduct.
16. Privacy
How we collect and handle your personal information is set out in our Privacy Policy. By using the Site, you agree to the terms of the Privacy Policy.
17. Changes to these Terms
We may update these Terms from time to time. The version in effect when you place an order is the version that applies to that order. The "Last updated" date at the top will reflect any changes. Continued use of the Site after changes are posted means you accept the updated Terms.
18. Termination
We may suspend or terminate your access to the Site at any time, with or without notice, where you breach these Terms or where we reasonably believe doing so is necessary to protect our business, our customers, or the Site.
19. Severability
If any part of these Terms is found to be unenforceable, the rest will continue to apply.
20. Governing law and jurisdiction
These Terms are governed by the laws of Victoria. You and we submit to the non-exclusive jurisdiction of the courts of Victoria and the courts of appeal from them.
